Attorney Sidney Powell responds to DOJ's sudden change of standing and their smears on General Flynn
The DOJ previously asked for no jail time.
The DOJ is now accusing Flynn of being uncooperative and failing to accept responsibility for his "serious" offense.
According to Mike Flynn's brother Joseph Flynn, General Flynn went through 19 sessions with Mueller's special counsel team and approximately 90 hours or tortuous interviews.
The judge previously set Flynn's sentencing date for January 28 after rejecting Sidney Powell's request for Brady Material.
"Given the serious nature of the defendants' offense, his apparent failure to accept responsibility, his failure to complete his cooperation in — and his affirmative efforts to undermine - the prosecution of Bijan Rafiekian, and the need to promote respect for the law and adequately deter such criminal conduct, the government recommends that the court sentence the defendant within the applicable Guidelines range of 0 to 6 months," the feds wrote.
The DOJ is now claiming that Flynn "has not substantially assisted the Government."
Prosecutor Brandon Van Grack said Flynn's assistance in the Special Counsel's investigation was "never substantial."
This is completely the opposite of what they said in earlier statements.

But that appears to have been the judge's intentional lull - most likely for political - not judicial - reasons. Those times have apparently passed, and now we are back to the norm.
I'll tell you one federal Judge who's honest: the NYC lady who forced the prosecutors to say that they could not state that they would NOT execute, without a warrant, etc., ANY of the plaintiffs, including a few nuns, as I recall. She issued an injunction against the NDAA (ENDING her hopes for ANY advancement/promotions in the Judicial branch); but SHE had - and holds - something far more valuable, her integrity!Her injunction was quietly stayed and the appeal treated likewise.

Remember all the folks getting released for drug crimes, murders, death row, because the prosecution had hidden the 'Brady Material'?
It damn sure makes MORE sense to resolve such issues now - not later. Justice delayed is justice denied.
This is the same type of BS that was used on the poor Kid Aaron Schwartz? for posting medical articles hidden behind a paywall online.
Meanwhile, folks who buy drugs from cops get minimum mandatory 5 years; and I've walked a guy who, when drunk, liked to insult girlfriends/wives (I rep'd him for the third arrest he'd done this - that was known about.) If he won the fight, fine. If he was losing, he would whip out a buck knife and stab the other guy. Third time (victim almost died, last rites, etc. But got blood survived just fine...then so for this prick's THIRD attempted murder, I got him 5 months, time served. But this was in 1988. Thus, I'd not be surprised at all if he's long since died from Hep. C.
There was no room in the prisons for THAT PRICK.
Meanwhile, same week, a 16 year old, charged as an adult facing - depending on how the cops and prosecutors approached it - 5 -15 years, no good time/gain time, if we took it to trial. (Courts have ruled it's OK to punish folks who take their cases to trial.) So, the BEST we could do was 18 months at Raiford/Starke . . . no violent history at all; only bought drugs from cops and sold them to informants.)
While they had ROOM for he of that victimless crime; there were NO Prison Rooms available the fight cheating backstabber walked with about five months. Those cases resolved within the same workweek. That was when I simply quit doing criminal law. (And it's WAY, WAY more broken now.) Ask any attorney what they think of the 'war on drugs' (sic) -really on Americans' freedoms.
