Daniel C. Anderson, 32, was arrested in 2014 after a neighbor reported a man looking through the girl's bedroom window. He was apprehended by Eau Claire police and admitted to making the recordings.
The officers found a four-minute video of the girl showering and getting dressed on Anderson's cell phone. They also uncovered twelve more nude videos of the girl and four nude videos of her mother. The video of the girl was uploaded to the Internet and made "accessible to the public," according to court records.
Anderson will be on probation for two years and is required to complete 20 days of community service, according to WQOW.
Judge William Gabler gave Anderson the option of spending 20 days in jail or performing community service after he pleaded no contest to two felony counts of capturing an image of nudity without consent.
Anderson had also faced a felony count of possession of child pornography, four misdemeanor counts of invasion of privacy and misdemeanor counts of obstructing an officer and disorderly conduct — but those charges were dismissed.
As part of his sentence, Anderson is prohibited from possessing any phone that has the ability to access the Internet.
Eau Claire County assistant district attorney Kelly Mandelstein insisted the sentence fit the crime because Anderson did not have a prior criminal history.
...for both growing the plant and the videos. It wasn't clear that "stalking" happened here. Looks more like voyeurism which is a non-violent offense. It is rare that a judge gets the latitude to attempt to fit the crime to the punishment (and to take other considerations into account like: 1st offense, family members or friends impacted by jail time, "victims" not wanting to press charges etc.). Most of the time the punishment is already predetermined as harsh (3 strikes, or guilty by association for example). This just feeds the private prison system with non-violent offenders and the "get tough on crime" and "zero tolerance" mind set. It is April fools day, but we can still practice compassion and tolerance.
