7-year-old New York boy charged with rape

A 7-year-old boy from upstate New York has been charged with rape, a report said Tuesday.

The child, of Brasher Falls near the Canadian border, was arrested by state police in connection with an incident that happened on Thanksgiving, according to local station WWNY.

He was charged with third-degree rape on March 23, the CBS affiliate said.

The boy was released and will be reportedly tried in Family Court.

A Queens attorney who handles youth defense cases told the station the case is "absurd."

"Instinctually, it shouldn't happen that a 7 year old — I don't think you even could really realize what you're doing at 7 years old," Anthony Martone told the station.

"They'd have to prove he actually physically committed this act, which to me it almost seems to be an impossibility."

Martone reportedly said it appears the boy is being charged as a juvenile delinquent, but a bill pending in Albany would raise the age threshold for that charge from 7 to 12.

Quite how a 7 Yr old of any colour knows about sex, let alone rape is beyond me. I was still having cuddles with my mum at 7.

Christian83 More likely the product of SRA. I'd bet the kid himself has been subjected to the same from 18 months of age. That's where they get the idea from. This is well reported in psychological trauma-abuse literature.

Now, whatever the law is on this matter would be sufficient, though practically that means there would be no proof; and no context was provided, as it should be. But, the above is a stupid, naive thought to have, and outside of the court it is insensible. I just say that as a warning. Because I care. Well not at all, it's because it's the obvious truth.

The argument could reasonably be made that 7-year-olds generally know nothing about it, or shouldn't. But many do.

People would read Salter's "Predators" if they were for some reason actually begging to learn why a child could understand what is going on, and that understanding would belong to both victims and perpetrators among children, the perpetrators often having been victims themselves. And apart from that, unsheltered kids learn from older peers, especially by that age, and so-called "wise" kids would by definition know why it happens or why they would do it. Wasn't it the Columbine shooters who knew from the time they were 8 or 9 that they hated everyone, according to their journals? Maybe I don't remember that correctly.
