It is precisely this attitude by public officials (to include the judiciary) at all levels and all political persuasions that is causing (has caused?) the descent of the US into a tyrannical police/surveillance state where gov't integrity and adherence to the "rule of law" is at the same level as found in a typical banana republic.
This way of looking at things has allowed continuous foreign meddling and wars, indefinite detention, torture, and extra-judicial killing even of our own citizens, the excesses of civil asset forfeiture, violent no-knock midnight raids and arrests/killings by "law enforcement" of people in their homes, secret police and secret courts, warrantless surveillance of all electronic communications, gov't policies designed for the good of big political donors and/or people/firms with influence, blatantly unethical and self-enriching behavior by public officials, as well as the complete breakdown of the concept of equality under the law.
While the 1st amendment guarantees Mr. Loomis the right to express those opinions, the fact that he uses his official position to try to go around the Constitution he is sworn to uphold is despicable. He (and all officials who want to ignore the Constitution whenever it suits them) need to be immediately removed from their positions.
If one doesn't agree with some provision in the Constitution, there is a clearly prescribed manner of trying to amend it. Bypassing Constitutional provisions via decrees by gov't officials whenever it suits them is a clear indicator of tyranny and/or banana republic-hood.
