In a gesture that is more symbolic than punitive, the family of Leiby Kletzky has filed a wrongful death suit against the child's admitted kidnapper and killer Levi Aron.

The slain boy's father, Nachman Kletzky, is seeking more than $100 million in damages from the psychopath that abducted his son as he walked home from day camp last month, later smothering the child.

A civil suit filed with the Brooklyn Supreme Court states that Leiby Kletzky:
was terrorized, physically and psychologically assaulted and injured, and was murdered and his body dismembered, with parts of his body hidden in a refrigerator.
The father, who had initially been shielded from the gruesome details of his son's death, only learned in recent weeks about the manner in which the crime was carried out. Aron, who confessed to killing the 8-year-old, told the police and district attorney that he poisoned the boy with pills and smothered him with a towel, then dismembered the body.

Even though Aron's defense team will seek an insanity defense, the 35-year-old Brooklyn native has been adjudged fit to stand trial. The likelihood of a murder conviction seems almost a foregone conclusion.

It is equally unlikely that the Kletzky's will never receive a penny from their son's killer, who lived on the top floor of his parents' house, but clearly the purpose of their wrongful death action is to make a statement about their loss - which in the end is incalculable.
