The motion named Dr. Lynn Fenton as defense attorneys sought to gain access to a package James Holmes had mailed to her prior the July 20 mass shooting, which also wounded 58 people.
Reports surfaced Wednesday that Holmes -- who recently dropped out of the University of Colorado -- had sent a notebook to a university psychiatrist that included details and drawing of his plans to kill people.
There were conflicting reports about whether the package reached the school in time to potentially prevent the massacre, but officials remained tight-lipped due to a strict gag order imposed by the judge overseeing the case.
Judge William Sylvester unsealed some court filings Friday after defense attorneys argued that Holmes's constitutional rights had been violated by the "breach of confidentiality and privilege" and sought "sanctions for this misconduct."
In Cape Coral, Florida, on Wednesday, Kenneth Roop was arrested for shooting and killing Nicholas Rainey, an unarmed door-to-door salesman on his property (video below).
Roop has been charged with second-degree murder, reports The News-Press.
A co-worker saw Rainey knock on Roop's door, but receive no answer. While Rainey was walking down the drive way, Roop drove up in his pickup truck and asked why Rainey was there.
Rainey said that he was selling steak and seafood. The co-worker said Roop pulled out a handgun and shot Rainey. As Rainey lay on the ground, Roop fired another bullet into the back of his head.

Unsuspecting tourists travelling in hire cars or British registered vehicles are particularly vulnerable on the AP7 stretch of motorway between the French border of La Jonquera and the Alicante region of Southern Spain where so far 140 cases of theft have been reported to local British consulates.
Some might speculate that the rise in motorway crime by well organised gangs has been exacerbated by the perilous state of the Spanish economy but in reality such tricksters have been using the same scams to rob tourists for many years. A popular ruse employed at motorway service stations involves surreptitiously puncturing a tyre and then offering to help the driver while an accomplice steals valuables from the vehicle. Another scam includes making loud bangs when a tourist's car is in transit causing the driver to pull over on to the hard shoulder. A fellow road user quickly pulls up offering assistance while a gang member steals from the victim's car.
In Aurora, Colorado, Jamie Rohrs took his girlfriend Patricia Legarreta and their two young children to the now infamous midnight showing of 'The Dark Knight Rises.'
When the shooting happened, Rohrs did not try to protect his girlfriend or their children, but actually ran for the exit and got into his car, leaving them behind. (Video below.)
Fortunately for Leggareta, a stranger, 19-year-old college student Jarell Brooks, escorted her and her children to the exit.

Randy George Scott, who posted a video (below) on YouTube of himself driving up to 186 mph on the Trans-Canada Highway, walked into the Kelowna, British Columbia police department and surrendered because of a warrant out for his arrest.
Kelowna police said in a statement: "The man allegedly responsible for the infamous YouTube video 'Victoria Highway Run 299km' is in custody."
According to CNN, Scott videotaped himself speeding on the 50 mph highway, dangerously weaving around cars.

Ever since suspected gunman James Holmes' seemingly dazed televised court appearance Monday, speculation has run rampant on whether or not the man accused in the Aurora, Colo., massacre may have deeper psychological problems.
Chicago clinical psychologist Daniela Schreier told CNN that it was possible that Holmes was a longtime psychopath with a violent streak who snapped. Meanwhile, Marissa Randazzo, former chief research psychologist for the U.S. Secret Service and an expert in mass shootings, told Good Morning America that Holmes' previous behavior didn't suggest he was a psychopath or a sociopath.
The court of public opinion following the tragedy also included many voices judging Holmes to be a psychopath. These people may be right - but probably not for the reasons that they think. The psychopath label has been used so much, it has become a broad term that's real meaning has been lost among everyday citizens.
"It's like a 'nervous breakdown,'" Dr. Michael First, a professor of clinical psychiatry at Columbia University, told CBSNews.com. "It's all these words that people use with no precise meaning."
"The word has been borrowed from a technical term," First added. "If a psychologist or a psychiatrist says it, it probably has a specific meaning. If a member of the public says it, it normally means a very bad person."

The officers then reportedly joked that Manos would "have a story to tell at Thanksgiving."
Instead of a story to tell, Manos and her fiance, Eric Otto Ryder, have sued Los Angeles County and the Los Angeles County Sheriff's Department.
The lawsuit says that the officer's warrant was clearly marked and intended for apartment 'C,' while Manos lives in apartment 'A.'

Chinese prosecutors investigating the death of the British businessman Neil Heywood are to charge Gu Kailai, the wife of the disgraced Chinese politician Bo Xilai, with the murder.
The official Xinhua news agency reported that the indictment in the case said Gu had had a falling out with Heywood and was worried that it would threaten her and her son's safety.
The report says Gu and a family aide, Zhang Xiaojun, who is also charged with murder, are alleged to have poisoned Heywood together.
Bo was removed from office this spring and the investigation into his family is the biggest political scandal the normally secretive Chinese leadership has faced in decades.
The brief report is the first official news that the case against Gu is proceeding since the announcement three months ago that she and Zhang were being investigated and that Bo was being suspended from the powerful politburo for unspecified discipline violations. Xinhua did not mention Bo's case.
