California, Elk Grove - A disabled Elk Grove woman who was allegedly beaten by her 11-year-old son has died, according to Elk Grove police.


Police say 51-year-old Tracey Gipaya died of a pre-existing condition and they do not anticipate filing any new charges against the boy.

Investigators say the 11-year-old boy was arrested at his elementary school last week for allegedly beating his own mother so badly that she was hospitalized. He has been charged with assault with a deadly weapon and elder abuse.

"She did have injuries to her arms, to her legs, to her back and other areas that we believe were a direct result of her son causing the abuse," Elk Grove Police Officer Chris Trim said when the boy was arrested

Elk Grove police say the young boy lived in the home alone with his 51-year-old, severely physically disabled mother and became her unofficial caregiver.

"I cannot recall a case in which a kid has been taken into custody on charges of abusing a parent who has fiduciary responsibility for the child," said Officer Trim. "Typically the situation is reversed. A kid will go to school with marks or bruises, and someone calls police and the parent is arrested."

Yesterday, the boy's father was given temporary custody of his son by a juvenile court judge.

The boy's biological sister from Southern California was also in court pleading with the judge to release the boy into her custody. The judge denied her request and she denied to answer our questions as to why the boy shouldn't go with her father.

"None of your damn business," she said as she left the courthouse.
