Best of the Web: ACTA -- A Patriot Act For the Internet
This week 40 or so countries are meeting in South Korea to consider text for a new international agreement on the enforcement of intellectual property rights. It is called the Anti-Counterfeiting Trade Agreement (ACTA). The term "counterfeiting" is designed to demonize the agreement critics as friends of organized crime, much like the name of the Patriot Act seemed better than the "Elimination of Civil Liberties Act." It is really an agreement that addresses a wide range of intellectual property enforcement issues -- involving patents, copyrights, trademarks and other IPR. (Details here)

If you are a lowly member of the public, the text is secret. The names of persons who attend the meetings are secret. The titles of the documents are secret. If you represent a big firm or law firm -- pretty much any big firm it seems, the U.S. government will show you documents after you sign a non-disclosure agreement - curbing your right to speak out on the contents of the documents you see.

As this shows, it collects all the worst ideas around copyright infringement - third-party liability, limited safe harbour rules, "three strikes and you're out", anti-circumvention legislation etc. - and wants to make them mandatory in most of the developed world.

But step back a minute, and notice what I've just written: the worst ideas around *copyright infringement*. And yet time and again ACTA governments around the world have insisted that this is not a copyright treaty, but a treaty to fight counterfeiting by large-scale, organised crime - it's even in ACTA's name.

And yet the measure above will affect every person on the Internet by virtue of limiting what they can do with copyright materials - even ones whose copyright they own - and generally having a chilling effect on online activity. This section is almost entirely about copyright and the average user, not large-scale counterfeiting and organised crime.

It is surely no coincidence that the last piece of the ACTA puzzle to be revealed is the most contentious, and turns out to precisely the kind of thing that the governments concerned have been strenuously denying. This is out-and-out deception of the most cynical kind, and emphasises once more why the ACTA process should have been conducted out in the open from the start. Had that been the case, it would not have been possible (a) to lie about the real intent of the treaty and (b) to sneak in devastating proposals right at the last minute when much of the treaty has been discussed and maybe even finalised, and when fighting them is even harder.

The whole ACTA saga is one of the most nauseating demonstrations of the contempt in which the Power-that-Be hold ordinary people and their interests. Sadly, it is not clear to me how to fight it: when most of the industrialised governments are hell-bent on pursuing this collective course, firing off an email to your MP suddenly looks a bit limp. Any suggestions not involving insurrection?

Every phone call, text message, email and website visit made by private citizens is to be stored for a year and will be available for monitoring by government bodies.

All telecoms companies and internet service providers will be required by law to keep a record of every customer's personal communications, showing who they have contacted, when and where, as well as the websites they have visited.

Despite widespread opposition to the increasing amount of surveillance in Britain, 653 public bodies will be given access to the information, including police, local councils, the Financial Services Authority, the ambulance service, fire authorities and even prison governors.

They will not require the permission of a judge or a magistrate to obtain the information, but simply the authorisation of a senior police officer or the equivalent of a deputy head of department at a local authority.

Bush lawsuit challenging the secret state's driftnet surveillance of Americans' electronic communications.

This latest move by the administration follows a pattern replicated countless times by Obama since assuming the presidency in January: denounce the lawless behavior of his Oval Office predecessor while continuing, even expanding, the reach of unaccountable security agencies that subvert constitutional guarantees barring "unreasonable searches and seizures." A Swedish Member of Parliament has pledged support for a new investigation into the events of 9/11, adding that prominent political figures support the view that elements of the U.S. government were involved in staging the attacks.

An article headlined "The U.S. was part of the attack" in the Swedish newspaper Aftonbladet, highlights comments made by MP Egon Frid of the country's "Left Party".

"The U.S. administration knew of the terrorist attack before and was a part of it," Frid said in an interview with Swedish TV network TV4 on it's Kalla Facts (Hard Facts) programme.

"My curiosity has once again led me in new ways and to top it all, I have new theories about what really happened 9/11″ Frid writes on his blog.

The facts as presented by the Army and the media reference the shooting at Fort Hood just don't compute. While I routinely dismiss any "facts" disseminated by the Army and the state's propaganda wing, sometimes referred to as the mainstream media (MSM), there are some glaring inconsistencies in what has been reported about this tragedy.

First is the report the perpetrator was dead and then hours later the revelation that he was still alive. Exactly how long does it take to determine if a person is dead or alive? Could it be no one knew whom the shooter or shooters were and a story had to be concocted for public consumption? What happened to the two other "suspects" that were detained? What did they do to qualify as suspects and more importantly, what information surfaced that led to their release? One of the suspects reportedly stated he "was with the shooter."

Dissatisfaction with capitalism is widespread around the globe 20 years after the fall of the Berlin Wall that heralded the demise of European communism, a poll released Monday showed.

Only 11 percent of people surveyed across 27 countries thought free market capitalism is working well, while nearly a quarter -- 23 percent -- said the system is "fatally flawed." A bare majority, 51 percent, believed its problems can be solved with more regulation and reform, the poll said.

In only the United States (25 percent) and Pakistan (21 percent), did more than one in five people agree that capitalism works well in its current form, the poll conducted for BBC World said.

The survey of 29,033 adults comes after the worst global financial crisis since the 1930s Great Depression and amid celebrations of the anniversary of the fall of the Berlin Wall, which abruptly ended the Cold War.

You rip open the envelope and there it is: Another darned photo-enforcement traffic ticket.

The photograph, the zoom-in on the tag, it's you, baby. Your car. Two weeks ago. Forty-one in a 30-mph zone.

It's from your favorite municipality. You can pay $40 now or $80 later. You can also contest it, the infraction letter says, and that's a laugh. You remember seeing that the folks who went down to fight their automated tickets in Montgomery County got convicted 99.7 percent of the time. Like a Soviet election, you think, a sham, a joke, and you, the chump in the parade.

There's something that doesn't smell right about these tickets, but you're not quite sure what.

Is it the huge profits the government and their cohorts, the camera manufacturers, make on them? The District doubling the number of tickets it issued just two years ago, raking in $36 million last fiscal year? The fact that Redflex, one of the big manufacturers of these cameras, posted a 48 percent jump in revenue last year while the rest of the economy tanked?

People get worked up. Put these cyborgs on a ballot, and the voters beat them to the pavement.
Comment: It is interesting for the Washington Post to present compelling statistical evidence for the ineffectiveness of speed camera's in reducing road injuries. It is true that as soon as the camera is behind a reckless driver they put their foot down again. These camera's have been introduced as easy profit generating machines and it is encouraging to see some success stories of the people fighting back against the machines.

Authorities bragged about an "openness policy" and transparency to better calm everyone regarding the safety of the "swine flu" vaccine. But then something happened. No more official reports were made of so called side effects or deaths.
